Expert Legal Help On Your Doorstep

Probate Charges

Grant of Probate only

We can help you through this difficult process by obtaining the Grant of Probate on your behalf.

Our charges start in the region of £750 plus VAT and disbursements for obtaining a Grant only for a straightforward estate where no inheritance tax is payable.

This includes: preparing the necessary tax form, preparing the Oath and obtaining the Grant.

For more complex cases where inheritance tax may be payable, charges would start from approximately £1250 plus VAT and disbursements.

Administration of the Estate

We can also assist you in administering the estate to include the collecting in and distribution of assets and dealing with any tax issues including inheritance tax where applicable. As the size and complexity of estates varies considerably, we are happy to discuss our likely overall costs based upon the particular case.

A typical estate with a property to sell or transfer and a few bank accounts and investments may cost in the region of £1250 to £2500 plus VAT and Disbursements (conveyancing charges are separate).

Where inheritance tax is payable, the costs are likely to be higher in view of the need to correspond with HMRC which involves the completion of detailed tax forms and calculation of the tax payable.

Some examples of complex estates where costs may be higher are as follows:

  1. Large number of beneficiaries
  2. Large number of shareholdings or other investments
  3. Where there is more than one property and/or foreign property
  4. Where there is a dispute over the estate
  5. Where inheritance tax is payable

We are always happy to meet with the personal representatives for an initial no obligation discussion to assess what may be involved in the administration of the estate and the likely costs.

A separate charge would be made for the conveyancing costs of a sale or transfer. An estimate can be provided when required by a member of our conveyancing team.

Examples of disbursements are:

  • probate court fee of £155 plus £0.50 per extra copy;
  • swearing the Oath-from £5 per personal representative;
  • bankruptcy searches (£2 per beneficiary);
  • Statutory advertisement in the London Gazette and a local newspaper to protect against unexpected creditors - from £150 plus VAT

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of disbursements on your behalf to ensure a smoother process.

Estates usually take between 3 – 6 months to deal with unless there is property involved or the matter is more complex.
